Case Status

The plaintiffs filed the case on February 4, 2008 in the San Francisco County Superior Court. The case is pending before the Honorable John E. Munter of Dept. 305 of the San Francisco Superior Court, Civic Center Courthouse, located at 400 McAllister Street, San Francisco, California 94102.

The Plaintiffs allege claims for failure to pay all hourly and overtime wages, provide rest and meal periods as required by California law, pay all wages due upon termination and provide accurate itemized wage statement, and violations of the Unfair Competition Law.

Catholic Healthcare West is represented by the law firm Sheppard Mullin Richter & Hampton LLP. Defendant filed its Answer on March 6, 2008, asserting various defenses and denying the allegations in the Complaint.

On April 8, 2008, the Court granted the Application for Complex Designation, and the matter was assigned to Judge Munter. The Judge will be very involved in overseeing the case and resolving disputes as they arise.

On July 31, 2009 attorney Chad Schwartz withdrew as proposed class counsel.

The parties have propounded and responded to discovery and have been meeting and conferring concerning the scope of the requests. The parties have also been taking depositions related to the claims in this case.

In December, 2009, Plaintiffs sought and were granted leave to amend their complaint to remove Medical Technicians and to limit the class to those Registered Nurses and Licensed Vocational Nurses who provide direct patient care in acute care units. The First Amended Complaint is the operative complaint.
